1. Agreement

These terms govern access to and use of the ParaglidingFlow software-as-a-service platform operated by Timothe Ember (ParaglidingFlow.com), Via Rubiana 20, 6025 Gentilino, Switzerland.

By using the service you agree to these terms. If you use the service on behalf of a school or company, you confirm you are authorised to bind that organisation.

2. Best-effort service — no guarantee

ParaglidingFlow is provided on a best-effort basis. Unless a separately signed written contract expressly states otherwise, we offer no warranty, guarantee, or commitment regarding uninterrupted availability, error-free operation, fitness for a particular purpose, or any particular outcome.

No service-level agreement, uptime commitment, support response time, or indemnification applies unless agreed in a signed contract between you and Timothe Ember / ParaglidingFlow.com.

3. Your responsibilities

You are responsible for account security, lawful use of the platform, the accuracy of data you enter, and compliance with applicable aviation, consumer, and privacy rules for your school operations. You must not misuse the service or attempt to disrupt it.

4. Fees and VAT

Fees, if any, are as agreed separately. Where Swiss law so provides for this offering, VAT is not charged. Invoices and payment terms may be set out in a signed contract or order.

5. Intellectual property

We retain all rights in the platform, branding, and related materials. You retain rights in your content and branding. You grant us a limited licence to host and process your content solely to provide the service.

6. Limitation of liability

To the maximum extent permitted by applicable Swiss law, we are not liable for indirect, incidental, special, or consequential damages, lost profits, lost data, or business interruption arising from use of the service.

Where liability cannot be excluded, it is limited to the fees you paid for the service in the three months preceding the claim, or CHF 100 if no fees were paid, except in cases of wilful misconduct or gross negligence where mandatory law provides otherwise.

7. Suspension and termination

We may suspend or end access for misuse, security risk, non-payment, or operational necessity. You may stop using the service at any time. Provisions that by nature should survive (including liability limits and IP) continue after termination.

8. Governing law

These terms are governed by the substantive laws of Switzerland, excluding conflict-of-law rules. Courts at the seat of the operator in Switzerland have jurisdiction, subject to mandatory consumer protections where applicable.
